1. General terms and conditions (GTC)
For orders placed via www.ilovetall,ch, Glärnischstrasse 7, 9524 Zuzwil/SG, all orders placed via the www.ilovetall.ch online shop and contracts concluded with info@ilovetall.ch and I LOVE TALL / Torus Swiss GmbH are subject to the following terms and conditions.
When concluding an order with I LOVE TALL / Torus Swiss GmbH, www.ilovetall.ch or info@ilovetall.ch by post, by telephone or in the online shop, you enter into a contractual relationship with Torus Swiss GmbH. This contractual relationship is governed exclusively by the "GTC".
These "GTC" apply to the order and delivery offer. Goods are only dispatched to delivery addresses within Switzerland and the Principality of Liechtenstein. Orders via this online shop can only be placed by persons of legal age with a valid place of residence.
Torus Swiss GmbH expressly reserves the right to amend these "GTC" at any time. The "GTC" in force at the time the contract is concluded shall apply.
2. Conclusion of contract
Contracts for www.ilovetall.ch are concluded in German, English and French. When ordering I LOVE TALL clothing articles, your contractual partner is Torus Swiss GmbH, Glärnischstrasse 7, 9524 Zuzwil.
The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. If there are products in the "shopping basket", this does not constitute a binding order until the "Send order" button is clicked. The order confirmation is sent immediately by means of an automated e-mail, but this does not constitute acceptance of the contract by I LOVE TALL / Torus Swiss GmbH. The contract is concluded by a contract confirmation or by delivery of the goods within ten working days.
Goods from the range in the online shop can be moved to the electronic shopping basket by selecting them and clicking on the "Add to basket" button. An order is only triggered when all the data required for the fulfilment of the contract has been entered, the acknowledgement of these "General Terms and Conditions" has been confirmed and the "Send order" button has been clicked. Until this button is clicked, the order and the data entered can be changed at any time.
Once the order has been placed, an automatically generated confirmation of receipt will be sent by e-mail. This contains the data of your order as well as these "General Terms and Conditions" and the data protection regulation. The confirmation of receipt does not constitute a purchase contract. The confirmation of receipt merely documents that the order has been received by I LOVE TALL / Torus Swiss GmbH. I LOVE TALL / Torus Swiss GmbH reserves the right to refuse to accept the order and conclude the purchase contract. The acceptance of the order by I LOVE TALL / Torus Swiss GmbH is subject to the availability of the ordered goods.

4. Prices
All prices are quoted in Swiss francs, including VAT.
I LOVE TALL / Torus Swiss GmbH may change or adjust prices at any time. The prices valid at the time of conclusion of the contract are decisive for each individual order.
5. Price reduction through promotions
If the order date falls within the period of a promotion with a price reduction, the customer is entitled to a price reduction on the items advertised in the promotion. If the order date is outside the specified period, there is no entitlement to a price reduction on items ordered as part of the promotion.
6. Payment methods
We generally offer the payment methods Twint, credit card and prepayment. For each order, we reserve the right not to offer certain payment methods and to refer to other payment methods. Please note that we only accept payments from accounts in Switzerland and within the European Union (EU). Any costs of a money transaction are to be borne by you. In the case of purchase by Twint or credit card, your account will be debited when we confirm the order.
If you pay in advance, the product will be reserved for you for a maximum of 7 days from the order date. If payment is not made within this period, the order will be cancelled without prior notification by I LOVE TALL / Torus Swiss GmbH.
7. Default of payment & assignment
If payment is not made within 30 days of the due date, the customer shall be in default. In this case, I LOVE TALL / Torus Swiss GmbH reserves the right to charge the customer a reminder fee of CHF 20.00 per reminder in addition to the invoice amount. The outstanding invoice amount (including interest on arrears and reminder fees) can be handed over or sold for the purpose of debt collection. In addition to settling the invoice amount, the customer is also obliged to reimburse all costs incurred as a result of late payment.
You agree to receive invoices, credit notes and reminders in electronic or paper form.
In the case of consumers, we retain ownership of the purchased item until the invoice amount has been paid in full. The corresponding security rights are transferable to third parties.
8. Dispatch and delivery
1. delivery is always with shipping costs.
2. the ordered goods will only be dispatched to addresses in Switzerland or the Principality of Liechtenstein.
3. within Switzerland and the Principality of Liechtenstein, we will send your delivery by Swiss Post. You expressly agree to the carrier with your order.
4. if despatch to a PO box is desired, only the following payment options are available: Credit card/advance payment
5 When the goods are handed over to the carrier (Swiss Post), liability is also transferred to the carrier.
6. if an article cannot be delivered for any reason after receipt of the order, you will be informed as soon as possible, but no later than 15 working days after receipt of the order. In this case, your order for the unavailable item will be deemed to have been rejected. For the available items, the contract is concluded in accordance with section 2.
9. Compensation for damages
Claims for damages due to incorrect illustrations, incorrect prices, incorrect texts, delayed or omitted deliveries are excluded and will be strictly rejected.
10. Reservation of title
The goods remain the property of I LOVE TALL / Torus Swiss GmbH, Glärnischstrasse 7, 9524 Zuzwil until full payment has been received.
11. Right of cancellation / return / returns
www.ilovetall.ch and info@ilovetall.ch I LOVE TALL / Torus Swiss GmbH grants you a voluntary right of return totalling 14 days from receipt of the goods. After this period, you can withdraw from the contract by returning the goods to I LOVE TALL / Torus Swiss GmbH within 14 days of receipt of the goods (period begins on the day after receipt of the goods).
Important: the return must be reported electronically in the online shop under your order. After the electronic notification, the return can be dispatched by you immediately. We can only accept returns with the electronic notification in the online shop.
Timely dispatch is sufficient to meet the deadline. However, in order to exercise your right of return, you must have only worn the goods to try them on, as in a shop, and return the goods complete and undamaged. We also ask that you return the goods in their original packaging. The right of return does not apply to the purchase of gift vouchers.
We will also refund any payments received within 14 days of the declaration of cancellation. However, we may refuse to refund you until we have received the goods back.
In the event of cancellation, please return the goods to us immediately in their original packaging. The costs for returning the goods by post are to be borne by you.

12. Warranty
The statutory warranty rules apply to defects in goods. Please report any recognisable, obvious material or manufacturing defects in our articles immediately upon delivery. We will replace the defective goods free of charge after the defective goods have been returned.
As far as legally permissible, other claims are excluded, regardless of the legal grounds. I LOVE TALL / Torus Swiss GmbH, its auxiliary persons and any vicarious agents are not liable for damages that have not occurred to the goods themselves, in particular not for consequential damages, loss of profit or other financial losses of the customer.
13. Our 100% guarantee
If the customer is not satisfied with the goods purchased in the I LOVE TALL fashion online shop after the cancellation period has expired for a reason in accordance with section 14, these can be returned to I LOVE TALL / Torus Swiss GmbH together with the invoice or proof of purchase, stating the reasons. The return is at the customer's expense and risk.
The customer can choose between exchanging the goods for an equivalent model, a voucher in the amount of the purchase price or a refund of the purchase price. Other warranty claims are excluded.
The right of return on the basis of the 100% guarantee exists only on presentation of the proof of purchase or the invoice and applies to clothing items that were purchased at full price from I LOVE TALL / Torus Swiss GmbH.
14. Social media
Once the user has given their consent, I LOVE TALL / Torus Swiss GmbH reserves the right to publish content from customers that they post on social media and that is directly related to the company I LOVE TALL / Torus Swiss GmbH (e.g. by depicting the products or using a hashtag such as #ilovetall, #ilovetallfashion or similar) on its website and to link the content to the corresponding products.
15. Image rights
All image rights are held by I LOVE TALL / Torus Swiss GmbH, Glärnischstrasse 7, 9524 Zuzwil. Use without express authorisation is not permitted.
16. Disclaimer for external links
Our website contains links to other sites on the Internet. The following applies to all these links: www.ilovetall.ch expressly declares that it has no influence whatsoever on the design and content of the linked pages. Therefore, I LOVE TALL / Torus Swiss GmbH hereby expressly dissociates itself from all contents of all linked third-party sites on www.ilovetall.ch and does not adopt these contents as its own. This declaration applies to all links displayed and to all content of the pages to which links lead.
17. Applicable law / place of jurisdiction
The substantive law of Switzerland shall apply exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
Any legal disputes in connection with the online shop and your purchase of goods must be settled in Switzerland, either before the ordinary courts at your place of residence or at the registered office of I LOVE TALL / Torus Swiss GmbH. The place of jurisdiction is determined in accordance with Art. 22 of the Swiss Jurisdiction Act.
Should individual provisions of these "GTC" be / become invalid or ineffective or should the "GTC" contain loopholes, the validity of the remaining provisions and the "GTC" shall remain unaffected. Invalid or missing provisions shall be replaced by dispositive law.

19. Gift vouchers GTC
Gift vouchers are vouchers that you can purchase. These can only be redeemed for the purchase of I LOVE TALL products, but not for the purchase of other gift vouchers. If the balance of a gift voucher is not sufficient for the order, the difference can be made up using the payment options offered. Gift vouchers and credit can only be redeemed before completing the order process. The balance of a gift voucher is neither paid out in cash nor does it earn interest. To redeem gift vouchers on your customer account, please use your voucher code during the checkout process.
